Riesgos Legales en las Administraciones Públicas y el archivo del email
Estos son los riesgos legales que pueden correr las Administraciones Públicas (Ayuntamientos, Consejos Comarcales, Diputaciones, Policía, Hospitales, Colegios y otras AAPP del Estado) respecto al uso y al archivo del correo electrónico:
1. Cumplimiento con el R.D. 3/2010 con él se regula el Esquema Nacional de Seguridad en el ámbito de la administración electrónica.El plazo para la adecuación de las Administraciones Públicas a esta norma vence el 30 de enero de 2014.
2. Cumplimiento con la LOPD. El correo electrónico puede constituir en sí mismo un fichero de datos personales completo o parcial, estando sujeto a la normativa de protección de datos. El no cumplimiento de esta normativa conlleva una sanción de entre 40.001 a 300.000 euros
3. Conservación de documentos: Existen múltiples disposiciones legales que obligan a conservar durante un determinado plazo de tiempo ciertos documentos y comunicaciones. (Documentos Contables, Relaciones Laborales, Documentación Contractual).
